Text Messaging Terms & Conditions
Carriers require that organizations include a section on their website for text messaging terms and conditions. This ensures transparency about text messaging practices and compliance with 10DLC standards.
Terms & Conditions Requirements
Text messaging terms & conditions are required to secure an approved use case. They should be clearly labeled as such on your website and easily accessible, especially if there isn't a page dedicated to the terms & conditions. The terms & conditions must contain the following:
- A clear and prominent label ("Text Messaging Terms & Conditions", "Text Message Terms of Service", "Terms of Service", etc...)
- It should clearly state that by providing your phone number, you will receive text messages
- The types of messages the recipient can expect to receive. This must align with the use case type you select (Polling & Voting, Higher education, Public Service Announcement, Customer Care)
- If you are registering for the political or charity use case, please read the section Special Use Cases below for an additional requirement.
- Organization name
- Message frequency details
- Message and data rates disclosure
- Instructions for requesting help (Text HELP for help, contact [email address] for help)
- Opt-out instructions (Text STOP to unsubscribe)
- A link to the Privacy Policy
- The Terms & Conditions must be linked in the Contact Source Opt-in Language
You can use our Terms & Conditions Generator to help craft compliant terms for your website.
For Example:
Text Messaging Terms of Service By signing up for text message updates, you agree to receive political messages from [Your Organization Name] at the mobile number provided by the user. Message frequency may vary based on your interactions, upcoming events, or important notices from [Your Organization Name]. Message and data rates may apply. You can request help by responding to a text message with HELP or by emailing [email@example.com]. You can opt out of receiving text messages at any time by replying STOP to any message. See our Privacy Policy [here] |
Special Use Cases
If you are registering for the Political or Charity use case, your website's Terms & Conditions must describe the type of messages that correspond exactly to your approved use case. For these use cases, no additional types should be included.
- Political: If you only plan to send political messages, your Terms should specify “political" text messages. If you also intend to send donation-related messages under the Political use case, your Terms must clearly state “political and donation-related" text messages.
- For example: "By providing your phone number, you agree to receive political call-to-action text messages..." or "By providing your phone number, you agree to receive political call-to-action and donation-related text messages..."
- Charity: "By providing your phone number, you agree to receive donation-related text messages..."
